Tate – I’m forwarding this from others – a discussion about a South Carolina insurance coverage case – insurer waived attorney client and work product protections when it raised a defense that its denial of coverage was reasonable. By doing so the insured was entitled to discover all facts and evidence referring or relating to the insurer’s consideration of coverage even attorney client and attorney work product which normally is not discoverable.
